Donald Manasse Law Offices (“DMLO Conseil SAM”) is committed to the highest standards of data protection and professional confidentiality. As a law firm based in the Principality of Monaco, we process personal data in strict accordance with the Monegasque Law No. 1.565 of 3 December 2024 and the European General Data Protection Regulation (GDPR).

2. DATA CONTROLLER & PROFESSIONAL SECRECY

The Data Controller is DMLO Conseil SAM, located at Est-Ouest, 24 Boulevard Princesse Charlotte, MC 98000, Monaco. In accordance with article 308 of the Monaco Penal Code and professional regulations applicable to the bars and associations of which we are members, all communications with clients are confidential. Data protection rights do not override the confidentiality duties DMLO Conseil SAM owes to its clients.

 

3. LEGAL BASIS FOR PROCESSING

We process personal data based on the following grounds:

Performance of a Contract: To provide legal advice and represent you.
Legal Obligations: Specifically for Anti-Money Laundering (AML) and Know Your Customer (KYC) compliance under Monegasque law.
Legitimate Interests: To manage our website, ensure IT security, and maintain our professional network.


4. CATEGORIES OF DATA COLLECTED

As a law firm, we may process specialized categories of information:

Identification & Contact: Names, addresses, copies of passports/IDs for KYC.
Financial Information: Source of funds, bank account details for billing or escrow.
Case-Related Data: Information regarding your business, assets, family situation, or legal disputes.
Sensitive Data: When strictly necessary for the exercise or defense of legal claims, we may process data relating to health, political opinions, or criminal records (in accordance with Article 80 of Law 1.565).


5. DATA RETENTION

DMLO Conseil SAM commits to retaining data only for as long as necessary:

Client Files: Generally 10 years after the closing of the file, matching the statute of limitations for professional liability and commercial archiving.
AML/KYC Documents: 5 years post-relationship (extended in specific legal circumstances).


6. RECIPIENTS & CROSS-BORDER TRANSFERS

Your data is primarily processed within Monaco and France. However, given our international practice, data may be shared with:

Authorized Subcontractors: IT providers, accountants, or specialized forensic experts.
Legal Authorities: Courts, bailiffs, or opposing counsel (strictly within the scope of legal proceedings).
International Affiliates: When your case involves multiple jurisdictions (e.g., our associate office in Nice).

For transfers to countries without Adequate Protection (as defined by the APDP), we use Standard Contractual Clauses or rely on the necessity of the transfer for the establishment, exercise, or defense of legal claims.



7. YOUR RIGHTS UNDER LAW 1.565 AND GDPR

Right of Access: You may request confirmation of data processing. DMLO Conseil SAM reserves the right to charge a reasonable fee for additional copies and will verify identity prior to disclosure. Note that this right cannot be used to access documents subject to professional secrecy.
Right to Rectification: You may update inaccurate data at any time.
Right to Erasure: You may request your data to be erased except where the processing is required for a legal obligation (e.g., AML records).
Post-Mortem Directives: You have the right to define instructions for the storage or deletion of your data after death.
Right to Complain: You may contact the APDP (www.apdp.mc) if you believe your rights have been violated.
